Terms & Condition

In a sports-loving country like ours which has, in recent decades, produced a significant number of fine sportsmen and sportswomen in various categories, the importance of getting off to a good start – in terms of having access to the right training facility, sports gear, and guidance and guidelines from the get-go – simply cannot be overstated for aspiring sports people who wish to distinguish themselves.

1. These terms and conditions represent the final and complete agreement of the parties, and no terms or conditions in any way modifying or changing the provisions stated herein shall be binding upon Gunfire unless made in writing and signed and approved by an officer or another authorized person at Gunfire. No modification of any of these terms shall be implied by Gunfire’s shipment of goods following receipt of the buyer’s purchase order, shipping request or similar forms containing printed terms and conditions additional to or in conflict with the terms herein. If any term, clause, or provision is declared or held invalid by a court of competent jurisdiction, such declaration or holding shall not affect the validity of any other term, clause, or provision herein contained.
2. Acceptance of Orders – All orders are subject to written price verification by authorized Gunfire personnel unless designated in writing to be firm for a specified period. Shipment of goods without written price verification does not constitute acceptance of the price contained in the order.
3. Substitution – Gunfire reserves the right, without prior notification, to substitute an alternative product of like kind, quality, and function. If the buyer will not accept a substitute, the buyer must specifically declare that no substitution is allowed when requesting a quote or placing an order.
4. Price – Prices quoted, including any transportation charges, are valid for 10 days unless designated as firm for a specific period pursuant to a written quote or verified by an authorized Gunfire representative. A firm price may be revoked in writing before acceptance is received. All prices and deliveries are F.O.B. shipping point. Gunfire reserves the right to cancel orders if selling prices are altered due to government regulation.
5. Transportation – Unless otherwise provided, Gunfire shall use its judgment in determining the carrier and routing. Gunfire shall not be liable for any delays or excess transportation charges resulting from its selection.
6. Packing – Unless otherwise specified, Gunfire will comply with its standard minimum packing. Any special packing or loading requested by the buyer shall be at the buyer’s expense.
7. Payment Terms – Discounts apply only to the invoiced material value (not taxes or freight). Gunfire reserves the right to require advance payment or security based on buyer’s financial status. Failure to comply may lead to cancellation of pending orders. The buyer remains liable for all unpaid accounts.
8. Taxes and Import/Export Licenses – Gunfire will follow the applicable tax structure as defined by the Government of India and State authorities.
9. Title and Risk of Loss – Delivery to the carrier constitutes delivery to the buyer, with risk passing upon acceptance. Claims for damage during shipping should be directed to our customer service at +91 63663 56570. Claims for pre-carrier shortages must be submitted within 5 days, accompanied by the original transport bill signed by the carrier.
10. Return of Products – Goods may be returned within 10 days. Exchanges are allowed for wrong-size or manufacturing defects. Return freight is the customer’s responsibility. The following items cannot be returned or exchanged: bodysuits, lingerie & sleepwear, swimwear, jewellery, and accessories (except scarves, bags, and mermaid blankets).
11. Force Majeure – Gunfire is not liable for non-performance due to events beyond its control (e.g. natural disasters, government orders, war, transportation delays, shortages). Affected quantities will be eliminated without liability.
12. Reasonable Attorney’s Fees – In case of legal action for recovery or breach, the buyer shall bear reasonable legal and collection fees.
13. Liability – Gunfire is not responsible for injuries or damages arising from product use or installation. Errors in quantity or weight must be reported within 5 days, supported by signed transport documents. Valid claims will be resolved by shipment or credit at Gunfire’s discretion.
14. Warranty – Products are warranted to be free of defects and made per industry standards. This warranty excludes any other implied warranties. No employee or agent is authorized to extend additional warranties. Claims must be made within 5 days of product receipt.
15. Remedies and Limitation of Liability – Gunfire’s total liability is limited to product replacement, refund, or repair, at its discretion. No incidental or consequential damages will be covered. Remedies stated herein are the buyer’s exclusive recourse.
16. Selection – The buyer is responsible for determining suitability of goods and compliance with applicable laws. The buyer indemnifies Gunfire against any claims, penalties, or damages resulting from misuse or non-compliance.
17. Choice of Law – This agreement shall be governed by Indian law, particularly under the Indian Penal & Consumer Code. The agreement shall be treated as one between merchants.
18. General – Gunfire confirms that goods delivered comply with India’s fair labour standards.
